Parents Do Not Have an Absolute Right of Access to a Public School Campus
Darin Darby and Philip Marzec recently obtained a Summary Judgment for San Antonio ISD in a civil rights case filed by a student’s guardian who was issued a Criminal Trespass Warning. The Plaintiff’s attorney alleged various violations of constitutional rights based upon claims that guardians, and parents, have a right of access to a school campus. The order provides a good review of the case law on parental rights related to public schools.
